Terms of Service

1. Acceptance of Terms

By creating an account or using BeeCommons ("the Service"), operated by ClearLaunchHQ LLC, you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including teachers and any families or students who access shared content.

2. Eligibility

BeeCommons is intended for use by licensed educators and school staff. By signing up, you represent that you are at least 18 years of age and are using the platform in a professional educational capacity. You are responsible for ensuring that your use of BeeCommons complies with your school's or district's policies.

3. Teacher Responsibilities

As a teacher using BeeCommons, you agree to:

• Only enter information about students enrolled in your class
• Obtain appropriate consent from parents/guardians before sharing portfolio links or enabling parent portal access
• Use the platform in compliance with FERPA, COPPA, and applicable state privacy laws
• Keep your login credentials confidential and not share your account
• Not upload content that is inappropriate, discriminatory, or violates any third-party rights
• Promptly notify us of any unauthorized access to your account

4. Student Data

Teachers retain control over the student data they enter into BeeCommons. You represent that you have the authority to enter student information into the platform and that doing so complies with your school's data governance policies. BeeCommons processes student data solely to provide the Service and does not use it for any other purpose.

4A. Scope Limitations — Prohibited Data Types

BeeCommons is a classroom communication and family engagement tool. It is not designed, certified, or approved for the storage, processing, or transmission of sensitive student records. You may not use BeeCommons to store or process any of the following:

• Academic grades or grade books — including report cards, transcripts, or GPA records
• Disciplinary records — including suspensions, expulsions, behavioral incident reports, or records subject to disciplinary proceedings
• Special education or disability records — including Individualized Education Programs (IEPs), 504 Plans, eligibility determinations, or any records pertaining to a student's disability status, all of which are governed by both FERPA and the IDEA confidentiality provisions at 34 C.F.R. §§ 300.610–300.627
• Health, medical, and mental health information — including medication records, immunization histories, physical examination results, school nurse records, psychological and psychiatric evaluations, mental health assessments, therapy notes, and any other health-related information maintained in connection with a student's education
• Any other education records that your school or district designates as requiring heightened protection beyond what this platform provides

Student Interaction Scope. Students do not create accounts on BeeCommons and do not enter personal information into the platform. All student accounts are created and controlled by the teacher. The only actions a student may take are: (1) uploading a photo or file of their completed work to their portfolio, and (2) submitting a completed assignment through the platform. Both actions are visible only to the student's teacher and the parent or guardian designated by the teacher. BeeCommons does not collect any personal information directly from students.

Teachers are solely responsible for ensuring they do not enter prohibited data types into BeeCommons. ClearLaunchHQ LLC disclaims all liability for any consequences arising from a teacher's entry of prohibited data into the platform.

5. Content Ownership

You retain ownership of all content you upload to BeeCommons, including student work photos, newsletters, and messages. By uploading content, you grant BeeCommons a limited license to store and display that content solely for the purpose of providing the Service to you and your authorized users.

You represent that you have the right to upload any content you submit and that doing so does not violate any third-party rights.

6. Prohibited Uses

You may not use BeeCommons to:

• Violate any applicable law or regulation
• Harass, threaten, or harm any individual
• Upload malware, viruses, or malicious code
• Attempt to gain unauthorized access to other accounts or our systems
• Use the platform for any commercial purpose other than classroom communication
• Scrape, copy, or redistribute platform data without permission

7. Service Availability

We strive to keep BeeCommons available at all times but cannot guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any loss resulting from service unavailability.

8. Disclaimer of Warranties

BeeCommons is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements. Your use of the Service is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, ClearLaunchHQ LLC and BeeCommons shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, unauthorized access to student information, or service interruptions.

10. Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of BeeCommons after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
